Age Requirement

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater, to create an account, purchase products, or sell products on XynoxPocketHub. By using our Platform, you represent and warrant that you meet this age requirement. If we become aware that a user is under the minimum age requirement, we reserve the right to immediately suspend and terminate their account without prior notice.

Legal Capacity

You represent and warrant that:

• You have the full legal capacity to enter into and be bound by these Terms
• You are not prohibited by any applicable law from using our Platform or entering into contracts
• You are not located in a country subject to economic sanctions, embargoes, or trade restrictions that would prohibit your use of the Platform
• If you are entering into these Terms on behalf of a legal entity (company, organization, etc.), you have the authority to bind that entity to these Terms

Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times. Providing false, misleading, or fraudulent information is a violation of these Terms and may result in immediate account termination.

Account Creation

To access certain features of XynoxPocketHub, including purchasing and selling products, you must create a registered account. During registration, you will be required to:

• Provide a valid email address
• Choose a unique username
• Create a secure password
• Agree to these Terms & Conditions and our Privacy Policy

You may also have the option to register using a supported third-party authentication provider (e.g., Google, GitHub). By doing so, you authorize us to access and use certain information from that provider as described in our Privacy Policy.

Account Security Responsibilities

You are solely responsible for:

• Maintaining the strict confidentiality of your login credentials (username and password)
• All activities, transactions, and actions that occur under your account, whether authorized by you or not
• Ensuring that you log out of your account at the end of each session, particularly when using shared or public devices
• Keeping your registered email address active and accessible, as we use it for important account-related communications

Unauthorized Access

If you suspect or discover that your account has been accessed without your authorization, or that your credentials have been compromised, you must:

• Immediately change your password
• Notify us without delay at info@xynoxpockethub.com
• Review your account activity and report any unauthorized transactions

Account Restrictions

Each individual may only maintain one personal account on XynoxPocketHub. You may not:

• Create multiple accounts for any reason
• Share your account with another person
• Transfer your account to another individual
• Use another person's account without explicit authorization

Account Termination by User

You may request to close your account at any time by contacting us at info@xynoxpockethub.com. Upon account closure, public profiles will be removed and downloads disabled.

Marketplace Model

XynoxPocketHub operates as a third-party digital marketplace platform. We facilitate transactions between independent sellers and buyers but are not a party to any transaction between a Buyer and a Seller.

What XynoxPocketHub Provides

We provide:

• The technical infrastructure and platform for sellers to list and sell digital products
• The payment processing framework for secure transactions
• Buyer-facing discovery tools, search functionality, and browsing experience
• Seller-facing tools for profile creation, product listing, and sales analytics
• Customer support as described in these Terms

Becoming a Seller

Any registered user may apply to become a seller on XynoxPocketHub. We reserve the right to approve or reject seller applications at our sole discretion.

Seller Representations and Warranties

By listing a product on XynoxPocketHub, you as a Seller represent and warrant that:

• You are the original creator or have obtained all rights to sell the product
• The product does not infringe upon any third-party intellectual property rights
• The product is accurately described (features, compatibility, limitations)
• The product files are clean � free of malware, viruses, or malicious scripts
• You disclosed all included dependencies and third-party component licenses
• You have the legal right to sell the product in all operating jurisdictions

Listing Requirements & Approval

All products are reviewed for quality, security, and completeness before or after listing. Misleading listings will be removed.

Browsing and Purchasing

Creating an account is required to purchase products. By purchasing, you acknowledge that you have reviewed descriptions and compatibility, understand that all sales are final (per Refund Policy), and agree that you are purchasing a usage license, not item ownership.

License Usage Restrictions

Unless the product's license explicitly permits otherwise, you must NOT:

• Redistribute, share, resell, or sublicense the purchased product to any third party
• Claim original authorship or ownership of the product
• Use the product as the basis for creating a competing product for sale without permission
• Remove or alter any copyright notices, watermarks, or attribution credits
• Use the product in a way that violates any applicable law or these Terms
• Share or distribute your download link with others
• Use a purchased product for illegal, harmful, or unethical purposes

Buyer Conduct

Buyers agree to provide accurate payment info, never attempt payment system bypasses, refrain from false/malicious reviews, and treat sellers and staff politely.

XynoxPocketHub's Intellectual Property

All content owned/created by XynoxPocketHub (brand, logo, UI, platform code, graphics) is our exclusive intellectual property. Copying branding, using logos without permission, reverse engineering source code, or creating derivative works is strictly prohibited.

Seller Intellectual Property and License Grant

Sellers retain full ownership and copyright of their original works. Sellers grant XynoxPocketHub a non-exclusive, worldwide, royalty-free license to host, display, promote, and market the product listings for operational purposes.

Buyer License Grant

Buyers receive a limited, non-exclusive, non-transferable license granted by the Seller (Personal or Commercial depending on purchase). It does not transfer IP ownership and may be revoked upon breach.

The following activities constitute a material breach of these Terms, resulting in immediate account termination, legal action, and payout forfeiture:

Platform Provided "As Is"

XynoxPocketHub is provided on an "AS IS", "AS AVAILABLE", and "WITH ALL FAULTS" basis without warranties of any kind.

Specific Disclaimers

• No Warranty of Merchantability: Platform or products may not meet standards/expectations.
• No Warranty of Fitness for Purpose: No guarantee of suitability for specific use cases.
• No Warranty of Accuracy: Descriptions, previews, or listings may have inadvertent errors.
• No Warranty of Uninterrupted Service: Platform availability is not guaranteed error-free or uninterrupted.
• No Warranty of Security: No absolute guarantee against security breaches or harmful components.
• No Warranty of Third-Party Products: Third-party product quality/functionality is solely the seller's responsibility.

Exclusion of Certain Damages

To the maximum extent permitted by law, XynoxPocketHub shall not be liable for:

• Indirect, Incidental, Consequential, Special, Punitive, or Exemplary Damages
• Loss of income, revenue, business opportunity, goodwill, or profit
• Data loss, corruption, or failure of third-party products/sellers
• Unavailability, downtime, or unauthorized account access losses

Your Obligation to Indemnify

You agree to defend, indemnify, and hold harmless XynoxPocketHub and its affiliates from claims, liabilities, damages, and legal costs arising from:

• Your use of or access to the Platform
• Your violation of these Terms, laws, or third-party IP/privacy rights
• Any product listed, uploaded, or sold by you
• Any dispute between you and another platform user

Our Right to Control Defense

We reserve the right to assume exclusive defense control at your expense. You shall not settle claims without our written consent.

Applicable Law: Governed by the laws of Delhi.

Jurisdiction: Exclusive jurisdiction in courts located in India.

Dispute Resolution Process

• Contact support at info@xynoxpockethub.com.
• Formal legal remedies if unresolved after 30 days.

Waivers: Both parties waive rights to a jury trial and class action proceedings.

• Entire Agreement: Terms, Privacy Policy & Refund Policy form complete understanding.
• Severability: Invalid provisions will be modified or severed without affecting remaining terms.
• Waiver: Failure to enforce rights does not constitute a waiver.
• Assignment: Users cannot assign terms without consent; Company may assign freely.
• Force Majeure: Not liable for delays beyond control (Acts of God, internet failures, etc.).
• Notices: Official notices sent via email or website postings. User notices sent to: info@xynoxpockethub.com.
